Appeals Process in Civil Animal Cruelty Cases

Quick summary: Trial and Appeal of Civil Seizure Cases Involving Cruelly Treated Animals Handbook (PDF file) and Worksheet (XLS file)

Trial and Appeal of Civil Seizure Cases Involving Cruelly Treated Animals

The Texas Health and Safety Code, Title 10, Chapter 821 governs the treatment of animals.

Given the complexity of determining the cost of care for animals in these situations, THLN asked a group of lawyers and animal welfare advocates to draft the information and guidelines for judges, lawyers, and others who may be involved in the process. The information in the seizure handbook is not legal advice and should not be construed as such. It is intended to inform and generate awareness of the new law, and provide a starting point for administering it. The following are included in the seizure handbook:

  • The Appeal Process
  • Worksheet to Calculate the Amount of an Appeal Bond
  • Listing of Typical Housing and Care Costs
  • Copy of Texas Health and Safety Code, Chapter 821, Subchapter B
